*DISH Network PURCHASER'S Contract!

AGREEMENT, by and between Timberville Electronics, Inc. a Virginia corporation, having an office at 297 New Market Road, Timberville, VA 22853 ("Timberville Electronics"), and the Person, Persons or agent signing hereby jointly and severally bind ourselves, our respective heirs, executors, administrators and successors to the following. (“the Customer”)

WITNESSETH:

WHEREAS, Timberville Electronics is in the business of selling satellite equipment, Services and related products;
WHEREAS, The Customer wishes to contract Timberville Electronics to provide satellite equipment, services and related products;
NOW, THEREFORE, in consideration of the foregoing and the mutual covenants and agreements contained in this Agreement, and for other good and valuable consideration, the receipt and sufficiency of which are hereby acknowledged, the parties hereby agree as follows:

System prices are only valid for NEW DISH Network or DirecTV USA residential customers. 
Programming is not included in equipment price and is provided separately by DISH Network or DirecTV.
By purchasing a system or receiver, the Customer agrees that a Minimum, Qualifying Programming package shall be maintained on each receiver for 12 continuous months and that the Customer shall pay and keep current their programming account. 
The Customer must activate the Minimum, Qualifying Programming package within 10 days of receipt of equipment. 
System receiver must be authorized first before any additional receivers and all additional receivers must be authorized with system receiver . Minimum, Qualifying Programming package must be activated before any other programming. 
If purchasing for someone else, or giving as a gift, Timberville Electronics must receive from the Customer the recipient's name, address and phone # and the Customer shall be responsible for the programming obligation. 
If purchased as system, system receiver must be activated as new account primary receiver, and cannot be used as a replacement receiver, or as an additional ("slave") receiver. 
If purchased as an additional ("slave") receiver, receiver must be activated as a new additional receiver connection, and cannot be used as a replacement receiver. 
Only if purchased as a replacement receiver can the receiver be activated as a replacement for an existing receiver. 
Minimum, Qualifying Programming must be maintained and receiver(s) must NOT be deactivated for any reason within the first year (12 continuous months) and the programming account must be paid in full when due. All are required or the Customer shall pay the Cancellation Fees and/or equipment and installation cost payable to Timberville Electronics, Inc. 
If the Customer does not maintain Minimum, Qualifying Programming, the Customer agrees to pay the full undiscounted amount for the system including any and all equipment and installation cost payable to Timberville Electronics, Inc. 
This agreement is in addition to any agreement you may have with your satellite programming provider. 
If the Customer does not meet all of these obligations, the Customer agrees in advance to pay a $300 system Cancellation Fee and a $75 Cancellation Fee for each additional receiver plus any and all equipment and installation cost listed below or as stated on the Customer’s work order, plus any and all Attorney fees and collection costs including interest at a rate of 24%APR. The Customer authorizes Timberville Electronics or their agents to collect these amounts, including an automatic, pre-authorized charge on the Customer’s credit card. 

Additionally, the Customer authorizes Timberville Electronics, Inc. to investigate the financial responsibility and credit worthiness (including, without limitation, acquiring credit reports and histories). Timberville Electronics’ maximum liability under this contract is limited to warranty replacement of equipment only. Timberville Electronics shall not beheld liable for any incidental or consequential damages for breach of any expressed or implied warranty on this system, nor for any incidental or consequential damages resulting from the use of, or inability to use, this system. Replacement as provided under the manufacturer's warranty is the Customer’s exclusive remedy.

Additional documents signed buy the customer, including the Work Order, Installation agreement and Sales Disclosure are part of this contract. 
Compliance with this contract shall be determined at the sole discretion of Timberville Electronics, Inc.
